Terms and conditions MECC FREE WIFI
1. Definitions
1.1 MECC Free Wi-Fi: the service whereby MECC Maastricht B.V. provides the User with access to the internet at Access Points via MECC Maastricht B.V.’s Wireless LAN network. User: a natural person who uses the MECC Maastricht B.V. facilities. Access Point locations: Locations where a MECC Maastricht B.V. Access Point is installed. www.mecc.nl: the MECC Maastricht B.V. website Users can access to ask their questions. Network provider: Supplier of internet access.
2. Applicability
2.1 These terms and conditions of use apply to the use of MECC Free Wi-Fi.
3. Use
3.1 The use of MECC Free Wi-Fi is free of charge.
3.2 MECC Free Wi-Fi is available at the premises of MECC Maastricht B.V.
3.3 In order to use MECC Free Wi-Fi, the User must have WLAN-compatible equipment that supports at least the IEEE 802.11b, IEEE 802.11g or IEEE 802.11n standards. The User must also have access to one of the following operating systems and one of the following internet browsers. Operating systems: Windows (Windows XP through Windows 10) or Apple iOS (all versions), and Android (all versions). Internet browsers: Internet Explorer, Firefox, Chrome, Safari, Opera, Maxthon and others.
3.4 MECC Maastricht B.V. notes that Users’ VPN (Virtual Private Network) software that does not support NAT (Network Address Translation) will not work via MECC Free Wi-Fi.
3.5 MECC Maastricht B.V. bears no responsibility and gives no guarantees regarding the accessibility of the Access Point locations for the User.
3.6 Issued usage specifications regarding MECC Free Wi-Fi, including the speed at which the User can use the internet, are indicative only. The speed also depends on the number of people using the Access Point location and the User’s distance from the Access Point.
3.7 Peer-to-peer traffic and streaming are not possible via MECC Free Wi-Fi. The file transfer (FTP) download and upload speed is geared to the number of other visitors, with a maximum of 2 MB/s.
3.8 The User will ensure that their use of MECC Free Wi-Fi does not cause unnecessary hindrance to other users of MECC Free Wi-Fi and the internet. The User will also ensure that their use of MECC Free Wi-Fi does not cause damage to the MECC Maastricht B.V. infrastructure or any another network provider used.
3.9 The User will at all times refrain from: – the unsolicited sending of large quantities of email messages with the same content and the unsolicited posting of a message with the same content in large numbers of internet newsgroups (spam); – sending or causing to be sent large quantities of unsolicited email messages to one particular email address or destinations (sites) with an IP address (mailbombing); – publishing or disseminating discriminatory and racist statements and child pornography; – stalking and other unwanted contact with people; – forcing their way into other computers or computer systems without permission (hacking); – infringing third-party copyrights or otherwise violating third-party intellectual property rights.
4. Security
4.1 The User is personally responsible for protecting their equipment and the software and files available on them from viruses and other harmful influences.
4.2 The use of the internet is also at the User’s own risk.
4.3 Data traffic between the equipment used by the User and the access point at the Access Point location is unencrypted. This means that there is a possibility that unauthorised persons may gain access to this data traffic. The User is responsible for security to protect against unauthorised access. MECC Maastricht B.V. accepts no liability for unauthorised access to the User’s data traffic by third parties.
5. Guarantee and liability
5.1 MECC Maastricht B.V. will make every effort to provide maximum availability of MECC Free Wi-Fi yet does not guarantee that MECC Free Wi-Fi will be continuously available without disruptions. MECC Maastricht B.V. does not guarantee that files and other data will be sent or received in their entirety, unchanged or within a certain period of time.
5.2 MECC Maastricht B.V. accepts no liability for any other damage, including yet not limited to damage to the User’s software, loss of files, physical damage to equipment and other data as well as any commercial damage.
5.3 MECC Maastricht B.V. is in no way responsible or liable for third-party services that the User accesses via the MECC Free Wi-Fi.
5.4 The User is liable for all damage incurred by MECC Maastricht B.V. as a result of any act or omission that is in breach of the provisions of these general terms and conditions and will indemnify MECC Maastricht B.V. from third-party claims against MECC Maastricht B.V. as a result thereof.
6. Suspension
6.1 In the event the User fails to comply with these terms and conditions of use, MECC Maastricht B.V. is entitled to suspend the User’s use of MECC Free Wi-Fi without being required to provide the User with prior notice of default.
6.2 If technical or business reasons or a change to laws and regulations so require, MECC Maastricht B.V. is entitled to terminate the MECC Free Wi-Fi service with immediate effect.
7. Privacy
7.1 MECC Maastricht B.V. will not store the User’s personal data.
7.2 The User’s navigation data are however stored by MECC Maastricht B.V. for a maximum period of three (3) months as this is required by law. Data will only be made available to the police or Public Prosecution Service if explicitly requested in accordance with the GDPR (General Data Protection Regulation).
8. Miscellaneous
8.1 MECC Maastricht B.V. is entitled to make changes to the MECC Free Wi-Fi service and the available Access Point locations.
8.2 MECC Maastricht B.V. is entitled to transfer its rights and obligations with regard to MECC Free Wi-Fi to a third party.
8.3 The User is not permitted to transfer all or part of MECC Free Wi-Fi or to make it available to third parties or to use it or allow it to be used in any way for the commercial provision of services to third parties.
8.4 MECC Maastricht B.V. reserves the right to amend these terms and conditions of use.
8.5 These terms and conditions of use as well as the agreement between the User and MECC Maastricht B.V. for the use of MECC Maastricht B.V. are governed by Dutch law. Any disputes will be submitted to the competent court in The Hague.
